As a Minnesota criminal defense attorney, my work often begins after something has gone terribly wrong on the road. The flashing lights have faded, the initial shock has worn off, and a person is facing the overwhelming weight of the legal system. Every week, I see how a few moments of poor judgment can lead to life-altering consequences, particularly in DWI cases. Recently, two stories from our state have highlighted the stark contrast between proactive efforts to build safer roads and the devastating reality of when things go wrong.
On one hand, we see a commendable legislative effort to strengthen the foundation of driver education. A new bill proposed in the Minnesota House aims to require anyone under the age of 21 to complete a formal driver’s education course before getting their license. Currently, this mandate only applies to those under 18. The logic is straightforward and sound: as our roads become more congested and distracted driving remains an epidemic, ensuring that our youngest and often most inexperienced drivers have a comprehensive understanding of both the mechanics and the responsibilities of operating a vehicle is a crucial preventative measure. This isn’t just about learning to parallel park or merge onto a highway; it’s about instilling a deep-seated respect for the law and an awareness of the severe consequences of negligence. A well-educated driver understands that a vehicle can be a weapon and that the privilege of driving comes with a non-negotiable duty of care to others. In theory, a driver who has completed 30 hours of classroom instruction is better equipped to avoid the mistakes that could lead to a traffic stop, an accident, or a DWI charge.
On the other hand, we are confronted with a grim and growing problem on Twin Cities streets: the alarming frequency of hit-and-run accidents involving pedestrians. Police are investigating these cases with frustrating regularity, where a driver strikes a person and makes the cold, calculated decision to flee. This is not a simple traffic violation. Leaving the scene of an accident, especially one that results in injury or death, is a serious felony in Minnesota, carrying the potential for years in prison and crippling fines. Why would someone make such a catastrophic choice? While panic is a factor, experience shows us that one of the most common reasons a driver flees is because they are impaired. They know that if they stay, they will face not only the consequences of the accident but also a DWI charge. In a moment of alcohol-fueled fear, they compound their initial mistake, turning a terrible situation into a legal nightmare from which there is no easy escape. Fleeing the scene is an admission of guilt for something—and that something is very often driving while impaired.
These two stories represent a critical crossroads for public safety in our state. The proposed driver’s education bill is a forward-thinking attempt to prevent the very kind of impaired and panicked decision-making that leads to a hit-and-run. It seeks to build a stronger culture of responsibility from the moment a young person first gets behind the wheel. However, all the education in the world can be undone by a few drinks. The lessons learned in a classroom about legal and moral responsibility are quickly forgotten when judgment is clouded by alcohol or drugs. The driver who flees the scene likely once sat in a driver’s ed class, but that knowledge was no match for their level of impairment.
Ultimately, safety on our roads is a matter of personal accountability. While we should support legislative efforts to improve driver education, we must also recognize that the most important decisions are made in the moments before a driver even turns the key. The decision not to drink and drive is the single most effective way to prevent a tragedy.
